Bankruptcy Fees

Filing Fees for Chapter 7, 11, 12 and 13

A personal note from Howard T. Duncan regarding bankruptcy fees:

The attorney fee in a Chapter 7 bankruptcy can be paid in monthly payments to my office. You pay an initial fee of $100.00 and can pay the remainder in installments prior to filing the bankruptcy.

I do everything required to represent you in the bankruptcy but I do not file the bankruptcy until I am paid in full because if I did so, I would be a creditor and I would be getting rid of the debt you owe me.

While you are making monthly payments to my office, this is the procedure:

  1. If a creditor calls, you may tell them you are filing bankruptcy and refer them to my office to confirm that by phone.
  2. If a creditor sues you, mail the document to my office. I cannot stop a lawsuit, but if you get it to me I will slow down the lawsuit so you have time to file bankruptcy.
  3. You can stop paying unsecured creditors such as Visa, MasterCard, medical bills, etc. since the bankruptcy will be getting rid of them.
  4. You must continue to make payments to secured creditors for items you want to keep such as your house or car.

It is important to note that if a client files Chapter 11 or Chapter 13, some of the attorney fees can be paid in the bankruptcy repayment plan. Please don't hesitate to contact my office with any other questions.
