Do I Qualify for Bankruptcy?

Omaha Chapter 7 and 13 Lawyer

The social stigma that has historically been attached to bankruptcy causes many people to hesitate to ask questions that they feel might cast them in a negative light. With millions of Americans seeking debt relief through bankruptcy each year, we hope that the negative connotation surrounding bankruptcy is soon to disappear.

At the office of Howard T. Duncan, Attorney at Law, we understand that most questions can be boiled down into one of two topics:

I've filed bankruptcy before. Can I file again?

Most often, the answer is yes. The Bankruptcy Code takes into account the fact that people might find themselves in the same challenging situation more than once over the course of their lifetime. You have the ability to file for Chapter 7 bankruptcy once every eight years, and a total of three times during your life. There is no such restriction on the filing of Chapter 13 bankruptcies.

How do I know if I qualify for Chapter 7?

Chapter 7 and Chapter 13 qualifications are typically determined by an examination of income versus expenses. Those who wish to file for Chapter 7 must complete a "means test" that measures finances. Even those who do not qualify for Chapter 7 still have the option to file for Chapter 13.
